Mediation in Saudi Arabia: Culture, Law, and Practice

Shariah law establishes both procedural norms and ethical standards for dispute resolution. Not only does it dictate formal adjudication processes, but it also endorses out-of-court settlements. Historically, Islamic jurists have emphasized mediation and amicable settlement as integral components of justice. Moral guidance is provided to mitigate conflict's adverse effects on social relationships. In line with this tradition, Saudi Arabia actively promotes mediation in different contexts, including commerce, labor, and criminal justice, particularly in reconciliations between families affected by homicide. This has been emphasized in Vision 2030 and reinforced through specific regulatory measures. Our forthcoming seminar will explore the theoretical and practical dimensions of mediation in Saudi Arabia, highlighting Shariah-endorsed ethical practices in dispute resolution. Additionally, we will present findings from a local survey that seeks to ascertain the influence of religious and cultural contexts on legal professionals' attitudes toward mediation.
